Welcome to BeAlok. These Terms and Conditions (“Terms”) govern your use of the BeAlok website and services. By accessing, using, or making a purchase on our website, you accept and agree to be bound by these Terms.

1. Services and Role of BeAlok
BeAlok operates a platform with two distinct services: a Directory for general listings, and the Curated Gift Packages where we sell multi-partner, themed packages directly to customers. For Package transactions, BeAlok acts as a Marketplace Facilitator and payment processor, managing the sale and directing fulfillment to the Partner Business (the "Vendor"). BeAlok is NOT the provider or warrantor of the underlying products or services contained within any Package; the Partner Business ("Vendor") is the sole provider of the underlying service.

 

2. Purchase and Fulfillment of Curated Gift Packages
2.1. Packages as Promotional Offers. Packages are sold at a substantial discount compared to the combined retail value of the components. The purchase of a Package constitutes acceptance of a time-limited promotional offer.

2.2. Package Expiration. Due to their promotional nature and discounted price, ALL PACKAGES AND VOUCHERS EXPIRE ninety (90) days from the date of purchase. Recipients must redeem the unique code directly with the Vendor within this 90-day period. BeAlok and the Vendor have no obligation to honor the Package after the 90-day expiration.

2.3. Redemption and Fulfillment. The recipient must contact the Vendor directly to arrange fulfillment. The Vendor is solely responsible for providing the service or product and honoring the code.

2.4. Payment. Once purchased, the package price is non-refundable by BeAlok except as required by law.

 

3. Third-Party Links, Vendors, and Content
Our Site includes links and listings for third-party businesses (Vendors). BeAlok does not screen, endorse, warrant, or guarantee any Vendor, their content, or their products/services. Any interactions, transactions, or disputes are solely between you and the Vendor, and BeAlok disclaims all responsibility in connection therewith.

 

4. Limited Refund Policy (Packages)
4.1. General Policy. ALL SALES OF CURATED GIFT PACKAGES ARE FINAL. BeAlok does not offer refunds or exchanges, except where explicitly required by the laws of the State of Maryland.

4.2. Disputes. If a Vendor fails to honor a valid Code, you must first attempt to resolve the issue directly with the Vendor. BeAlok, at its sole discretion, may investigate the dispute but has no legal obligation to refund the purchase price.

 

5. Disclaimer of Warranties
All services, listings, and content on BeAlok, including the Packages, are provided “AS IS” and “AS AVAILABLE.” BeAlok specifically disclaims all warranties. We do not guarantee the quality, safety, legality, licensing, or fulfillment of the services or products provided by any Vendor within the Curated Gift Packages.

 

6. Limitation of Liability and Indemnification
To the fullest extent permitted by Maryland law, BeAlok, its affiliates, officers, employees, and agents will not be liable for any damages arising out of or related to your use of the site or services, including those damages caused by a Vendor’s negligence, breach of service, or failure to fulfill a Package.

YOU AGREE TO INDEMNIFY BEALOK: You agree to defend, indemnify, and hold BeAlok LLC harmless from any claims, liabilities, damages, or costs (including attorney’s fees) arising out of or in connection with: (a) your breach of these Terms; or (b) any injury, damage, or loss resulting from your use of the products or services provided by any Vendor through a Curated Gift Package.

 

7. Intellectual Property
BeAlok may feature content from third-party Vendors. Such third-party content is the property of its respective owners. Unauthorized use of the BeAlok name, logo, or branding elements without express written consent is strictly prohibited.

 

8. User Conduct and Termination
By using this site, you agree not to use the Site for unlawful purposes, impersonate another person, or interfere with the Site’s operations. BeAlok may, in its sole discretion, terminate or suspend your access to all or part of the Site without notice or liability.

 

9. Governing Law and Dispute Resolution 
9.1. Governing Law. These Terms shall be governed by the laws of the State of Maryland.

9.2. Three-Step Dispute Resolution Process. Any dispute, claim, or controversy arising out of your purchase of a Package shall be resolved exclusively through the following steps:

Vendor Resolution (Step 1): The customer must first attempt to resolve the issue directly with the Vendor who provided the goods/services.

BeAlok Resolution (Step 2): If the dispute is unresolved by the Vendor, the customer must then notify BeAlok of the dispute in writing at [Your Legal/Service Email Address] and allow BeAlok a period of thirty (30) days to review the claim and attempt an informal resolution.

Mandatory Binding Arbitration (Step 3): If the dispute is not resolved after Step 2, the customer must proceed to Mandatory Binding Arbitration in Baltimore, Maryland, administered by the American Arbitration Association (AAA). You waive your right to a trial by jury and your right to participate in a class-action lawsuit.

 

10. Modifications and Severability
We reserve the right to update or change these Terms at any time without prior notice. If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions will remain valid and enforceable.
